Reporter: How many years have you been involved in the export business? Where is your major market? Have you been involved in the antidumping investigation?
Mr. Chen: We have done export trade for 5 years beginning in 2002. Our major destinations are Asia and Europe. The antidumping case is mainly against the steel fastener originating in China, not including the stainless steel products, so we are not in the list.
Reporter: Have you ever met similar investigations before? What measures have you taken?
Mr. Chen: Yes, we have. European Union issued an antidumping investigation against stainless steel fasteners made in China in 2005 and made final award to levy a tax on the basis of 11.4% to 27.4%. We were the only one to defend the proceedings in China at that time. We responded the case because we wanted to get the favorite custom duties. At that time, the antidumping duties were levied on the basis of 11.2% for those who actively responded the case and 27% for those who did not respond it. In order to win the case, we employed lawyers and experts from Beijing for help.
Reporter: Then can you give us some suggestions on responding such antidumping cases?
Mr. Chen: Recent years, with the diffusion of antidumping knowledge and the help from government, experts and industrial organizations, domestic companies are experienced in handling such problems and can well handling such cases. I'd like to focus on two points. First, it is better to answer the investigation rather than not. As we all know, the treatment to the actions and the inactions is different. So it will directly affect the benefits of the company. But we need master skills to deal with the investigations. In order to win the charge, we are better to associate with the domestic companies involved in the case. Second, we need prepare the relevant materials sufficiently and accurately. Because EU will send investigators to the involved company, we need prepare the references beforehand so that we can submit the materials to the relevant parties on time. Another important thing is we need to hire an experienced lawyer to represent for us.
Reporter: It is no doubt that fastener companies of China will be involved in various antidumping cases in future. What's your suggestion to avoid such antidumping actions?
Mr. Chen: The main reason for domestic products frequently involved in antidumping cases in EU and America is the severe price competition. I think the trade union should take price controls to avoid vicious competitions. The relatively lower price of domestic products is not reasonable and certainly will be boycotted by the EU members. In addition, as far as I know, the domestic companies mainly accept payment in advance or payment upon delivery of goods. In this process, we need to bear the risk and competition from interest expense and I hope concerning trade union can make a standard.
