European Commission made three amendments on the EU’s basic anti-dumping Regulation related to market economy treatment (MET) in recent. First, the period of ruling on MET made by investigating authorities should extent from three months to seven months after filing a case, no later than eight months at the latest; second, in the case of sampling investigation, it is stipulated that the investigation authorities will only examine the application for MET by sampling enterprises; third, in the case of sampling investigation, it is stipulated that the tax rate of all non-sampled enterprises should not exceed the weighted average of tax rate of sampling enterprises no matter sampling enterprises acquire MET or not.
Some fastener industrial insiders pointed out that the extension of investigation periods would increase the cost of respondent and lower respondent’s desire to apply for MET. In the meantime, it was unfair for the companies with the qualification of market economic status, who should enjoy the change of preferential antidumping rate and even zero tax rates, due to not be selected as sampling enterprises.
