Progress: China urges EU to abolish the anti-dumping measure against China’s certain fasteners

“According to the WTO rules, China is entitled to request WTO for the retaliation authorization.” On February 17, Spokesman of MOFCOM of China, Mr. Shen Danyang said to press when mentioning about China’s appealing of EU’s anti-dumping measure against China’s certain iron/steel fasteners.

On the afternoon of January 18 2016, Geneva time, the WTO published the appellate body report of the action of enforcement of the final anti-dumping measures dispute (DS397) of some Chinese steel fastener appealed by China against the EU. The appellate body of the action of enforcement of the anti-dumping measures dispute of the fastener comprehensively supported China’s position and proposition and once again ruled that the anti-dumping measures carried out by the EU on Chinese products violated the WTO rules. China positively welcomed and affirmed this support.

It is noticed that EU would plan to abolish its anti-dumping measure against China’s certain iron or steel fasteners and has presented this plan to the EU member countries for discussion, based on the report of international media. “We have known the relative reports suggesting EU’s abolishment of anti-dumping measure. However, we haven’t received any confirmation from EU side.” said Mr. Shen Danyang. “If true, it should be the correct process of EU to perform its duty and avoid the possible trade retaliation. China positively welcomes EU to complete its internal procedure and abolish the anti-dumping measure against China’s certain iron or steel fasteners soon.”

EU has levied 85% of the anti-dumping taxes on the steel fastener products imported from China since January 30 2009, which directly affected the export of China with a value of almost US$1 billion and the survival of thousands of enterprises of fastener and the employment of hundreds of thousands of people, causing huge economic loss to Chinese industries. Chinese industry expressed strong dissatisfaction with this. On the request of the industry, Chinese government appealed the EU’s measures to the WTO dispute settlement mechanism on July 31 2009 and won the lawsuit at the original panel and during the process of appeal.
